PIERCE, J. This is an action of tort tried to a jury. The declaration was in two counts, the first alleging ordinary negligence and the second gross negligence on the part of the defendant. At the close of the trial the defendant made a motion for a directed verdict in his favor on both counts. The Judge directed a verdict as requested on the first count, but refused to direct a verdict on the second count, and the defendant duly excepted. The jury returned a verdict for the plaintiff. The bill of exceptions contains all the evidence which is material to the defendants exception taken to the refusal to grant his motion.
